As of April 1, 2019, ICBC has made sweeping legislative changes that makes the Bronson Jones Injury and Functional Tracker imperative. ICBC has made changes on how they are dealing with people injured in motor vehicle accidents. ICBC is taking a more restrictive approach that will drastically reduce the amount of compensation available to an injured party. The vast majority of injuries will be deemed minor. Unless you have broken a bone in your accident, you will likely be put into the “Minor” injury category and your damages will be capped for pain and suffering. This will apply to whiplash injuries, soft issue injuries/muscular injuries to the neck and back, torn ligaments, psychological harm like PTSD and anxiety, and concussions. Only if your injuries “significantly impair” you ability to attend work, school, or do your own personal care for greater than 12 months will you escape the “minor injury” classification.

ICBC is in charge of deciding your case and determining if your injury is "Minor", and they will penalize those injured parties who need to work and earn a living and can’t afford time off.

“Minor” injury classification doesn’t take your personal circumstances into account. If you do not actively seek a diagnosis and pursue treatment immediately after an injury, ICBC can determine your injury to be minor, even if they are serious and significant.

If you strongly feel that your injury is not "Minor", you must wait a minimum of 12 months and then meet strict guidelines. Again, after 12 months, ICBC will decide if “Minor” injury applies to you.

If you disagree with ICBC’s decision, you no longer can challenge this in the Provincial or BC Supreme Court. Instead, you are obligated to apply to the online Civil Resolution Tribunal (the "CRT").

In many cases, lawyers may choose not to accept these types of claims if they are subject to the CRT. This is why the App is extremely important. With our without a lawyer, the App provides you with a valuable recording tool that substantiates your injuries.

Even in the event of “NO FAULT”, which is ICBC's new pathway, this tool is extremely useful and arguably, the App is more helpful as you may be left alone with NO lawyer and facing ICBC on your own.
